HealthArc Terms of Use (Beta)
1. Acceptance
By creating an account on HealthArc, uploading any record, or otherwise using the HealthArc service (“the service”), you agree to these Terms of Use. If you do not agree, do not use the service.
These are beta terms. They will be replaced with a reviewed production set of terms before HealthArc leaves beta. See the Beta Disclaimer for what “beta” means in this context.
2. Who may use HealthArc
You may use HealthArc if:
- You are an adult (18+) acting for yourself, or
- You are an adult (18+) acting as the primary family manager on behalf of members of your immediate family, including minors for whom you are the legal guardian.
You are responsible for:
- The accuracy of the information you enter or upload.
- Obtaining appropriate consent from adult family members whose records you add.
- Keeping your login credentials safe.
You must not use HealthArc to store or manage the records of individuals who have not consented, except as legally permitted for minors in your custody.
3. What HealthArc does
HealthArc is an informational and organizational tool. It helps you:
- Upload, store, and organize health records (labs, prescriptions, discharge summaries, documents, etc.) for members of your family.
- See summaries, timelines, and patterns derived from those records.
- Share selected records with healthcare professionals via short-lived links.
HealthArc is not:
- A medical device.
- A diagnostic service.
- A prescription or treatment service.
- A replacement for a qualified healthcare provider.
- A replacement for emergency services.
See the Beta Disclaimer for details.
4. Your data
You retain ownership of the health data you upload. By uploading data to HealthArc, you grant HealthArc a limited license to:
- Store, process, and display that data to you and the family members you have authorized.
- Run automated processing (OCR, parsing, classification, pattern detection, AI summarization) to produce the features described in §3.
- Use aggregated, de-identified patterns for service improvement. We will not use your identifiable records to train third-party AI models.
You can request deletion of your account and data at any time by emailing contact@healtharc.in. See the Privacy Policy for the deletion process.
5. Identity documents (beta restriction)
During beta, HealthArc does not accept storage of the following documents, even if the database schema anticipates them:
- Aadhaar number or Aadhaar card
- Indian passport number or passport image
- PAN (Permanent Account Number)
- Driver’s license
- Any national identity number outside India
The interface will not offer fields for these. HealthArc currently accepts only:
- ABHA ID and ABHA address (Ayushman Bharat Health Account — a health-specific public identifier).
- An optional uploaded photograph for profile purposes.
Do not attempt to store disallowed documents in free-text fields, attachments, or document uploads. If we detect such content, we may remove it and notify you.
6. Acceptable use
You agree NOT to:
- Upload content that is not health-related and not yours (or authorized family members’).
- Upload malware, pornography, illegal content, or content that infringes on third-party rights.
- Attempt to reverse engineer, probe for vulnerabilities, or disrupt the service.
- Use the service to provide medical advice to others, to practice medicine, or to present HealthArc output as medical authority.
- Create multiple accounts to evade limits or bans.
- Automate access to the service (scraping, bots) without our prior written consent.
7. Sharing with doctors and third parties
The service may provide short-lived links to share records with healthcare professionals. You are responsible for:
- Choosing recipients you trust.
- Revoking access when appropriate.
- Understanding that once a recipient has downloaded or screenshotted a record, HealthArc cannot control further distribution.
8. Beta status
HealthArc is in active development. We may:
- Introduce, change, or remove features at any time.
- Take the service offline temporarily for maintenance or deployment.
- Migrate data to new database schemas — we make reasonable efforts to preserve your data but cannot guarantee zero loss in beta.
- End the beta program with reasonable notice.
See the Beta Disclaimer for the full set of beta-period limitations.
9. Account termination
We may suspend or terminate your account if you violate these terms, if we are required to by law, or if operating your account poses a security or reputational risk to the service.
You may terminate your account at any time by requesting deletion (see §4).
10. Disclaimer of warranties
HealthArc is provided “as is” and “as available”. To the maximum extent permitted by applicable law, HealthArc disclaims all warranties — express, implied, statutory, or otherwise — including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted operation.
We do not warrant that:
- Automated parsing of your records is accurate.
- AI-generated summaries reflect clinically correct interpretations.
- The service will be free of bugs, interruptions, or data loss.
11. Limitation of liability
To the maximum extent permitted by applicable law, HealthArc and its operators shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the service, including but not limited to:
- Medical decisions made based on HealthArc output.
- Missed, delayed, or incorrect health information.
- Data loss or interruption of service.
- Unauthorized access to your data despite reasonable security precautions.
If, notwithstanding the above, HealthArc is found liable, the total aggregate liability shall not exceed the greater of (a) any fees you have actually paid to HealthArc in the twelve months preceding the claim, or (b) INR 1,000.
12. Indemnity
You agree to indemnify and hold harmless HealthArc and its operators from any claims, damages, or expenses arising from:
- Your violation of these terms.
- Your unauthorized upload of another person’s data.
- Your misuse of the service.
13. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, India.
14. Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top reflects the most recent change. Material changes will be shown to you in the app before you can continue using the service.
